MEMORANDUM OPINION

KENNEDY, District Judge.

Currently before the court is defendants’ motion to dismiss pursuant to Federal Rules of Civil Procedure 12(b)(1) and 12(b)(6), or in the alternative for summary judgment. After reviewing the motion, plaintiffs’ opposition thereto, and the record of this case, the court grants defendants’ motion and dismisses this case as moot.
