This is an action brought by the plaintiffs to quiet title to a tract of about one acre of land located in section 26, Township 6 North, Range 21 West, in Ravalli county. The facts in the case are not in dispute and are in substance as follows:

On December 16, 1893, the plaintiff Edwin W. Waddell was the owner of the land in question, and on that day he and his wife executed and delivered a deed'thereof to the trustees of school district No. 18 of Ravalli county, which contained the following: “To have and to hold, the said described premises together with the appurtenances, unto the said…
