In September, 1927, plaintiff commenced action against defendant for damages for the alleged 'wrongful destruction and removal from a school site of property belonging to the district. By answer defendant admitted the commission of the acts complained of, but denied any wrongdoing, and, as an affirmative defense, alleged that the site had theretofore reverted to him under the provisions of the deed by which he conveyed it to the district, and that the property in question was attached to the soil as a part of the realty.
