This is an action of tort, brought under the federal employers’ liability act, to recover damages for the death of Patrick McCarron, sometimes called Patrick McCarthy, who was a laborer in the employ of the defendant. On April 6, 1917, while working on the repair of the main line tracks at Kirkville in the county of Onondaga, State of New York, he was run over and killed by a train.
