FINDINGS OF FACT AND CONCLUSIONS OF LAW

FRANK W. WILSON, District Judge.

This is an action for personal injuries and property damage arising out of an automobile accident. The plaintiff has made alternative claims seeking to recover either from Billy L. Nabors as the driver of the vehicle involved in the accident, should it be determined that he was not acting in the course and scope of his employment with the United States at the time of the accident, or otherwise seeking to recover from the United States under the Federal Tort Claims Act, should it be determined that Nabors was acting within…
