The defendant David A. Warwick was charged and found guilty of one count of delivery of methylenedioxy amphetamine (MDA) and one count of manslaughter by having caused Forrest Bennett to consume a lethal quantity of MDA. The trial court entered judgment and sentence on the manslaughter verdict, but granted defendant’s motion for arrest of judgment and dismissed the verdict on the delivery count. Defendant appeals from the manslaughter conviction and the State cross-appeals from the dismissal of the delivery charge.
