DEWEY, District Jfidge.
The action is in equity to establish” and foreclose a vendor’s lien for an alleged unpaid part of the purchase price of certain real estate.
Appellant, the Parker-Washington Company, hereinafter referred to as the plaintiff, on and prior to the 18th day of June, 1923, was the owner of certain real estate located *233in the city of Kansas City, Mo. On that date- it sold this real estate to Harry J. Nicholas, appellee, herein referred to as the defendant.
