This is a suit arising in a justice court wherein plaintiff filed a statement alleging' that on June 18, 1923, he sold a house and lot located in Kansas City to the defendant; that at the time of the sale the city of Kansas City was the owner of a lien against such property in the sum of $92.13; representing a special assessment for the Turkey Creek Server; that plaintiff and defendant agreed at the time of the sale that the plaintiff should pay the defendant the sum of $92.13 “to pay said special assessment to Kansas City;” that by reason of a special bond election defendant was not required…
