The defendant was found guilty by the jury of the crime of homicide by negligent use of a weapon. The maximum sentence that the trial court could, impose for this crime is a fine of not more than $1,000 or imprisonment for not more than one year in the county jail or both. On such misdemeanor conviction, the trial court may withhold sentence or impose sentence and stay its execution, placing the defendant on probation for not less than six months, nor more than two years.
