Plaintiff in error was convicted on a charge that he did have possession of two gallons of Choctaw beer, with intent to sell the same, and in accordance with the verdict of the jury he was sentenced to be confined for 60 days in the county jail and to pay a fine of $100. From the judgment he appealed by filing in this court, on August 13, 1921, a petition in error with ease-made. The Attorney General has filed the following confession of error:
