The plaintiff in error, hereinafter called defendant, was convicted in the district court of Tulsa county of murder and sentenced to life imprisonment in the state penitentiary.

The record discloses that just prior to the time of the homicide a burglary of a mercantile establishment had been committed at Gentry, Ark., and property stolen. The police officers at Tulsa had been advised of this burglary, and defendant was suspected of having committed it.
