Plaintiff in error was convicted in the county court of Custer county, on an information wherein it was alleged that Abe Green, on the 2d day of September, 1909, sold one pint of whisky to Bill Howell for the price of one dollar. The information was filed on the 2d day of September, 1909. January 20, 1910, the case was' called for trial, and was tried without a jury; both parties having expressly waived a trial by jury- ’
