MEMORANDUM AND ORDER REGARDING DEFENDANT’S MOTION TO DISMISS
WOODLOCK, District Judge.
On December 12, 1981, plaintiff Lowell P. McKinney, a marine electrician, was injured on board the S.S. ROBERT E. LEE, a vessel owned by the defendant Waterman Steamship Corporation (“Waterman”). In 1984, McKinney filed a maritime tort action against Waterman in the Southern District of New York, but, in 1985, he voluntarily dismissed that action. In January of 1989, McKinney filed in this Court the instant law suit, essentially replicating his Southern District complaint. Waterman now moves for dismissal on…
