MEMORANDUM OPINION AND ORDER
HAIGHT, Senior District Judge:
This diversity case is before the Court on plaintiffs motion for partial summary judgment pursuant to Rule 56, Fed.R.Civ.P. For the reasons that follow, the motion will be granted.
BACKGROUND
The parties’ litigious relationship has spanned a number of years.
