Before proceeding to a discussion of, the merits of this case, we will consider a motion made by counsel for the defendants in error to dismiss the writ of error on the ground that the trial judge’s certificate to the bill of exceptions does not conform to the requirements of the Civil Code, § 5532. In this connection we will also notice the contention of counsel for the plaintiffs in error that a certain note or correction of the judge should not he considered as a part of the bill of exceptions.
