The Covington & Lexington Railroad Company, a’corporation created by the laws of the state of Kentucky, had constructed, and in the year 1858 was operating, its road from the city of Covington, in Kenton County, to the town of Paris, in the county of Bouibon, and had also secured a lease for the *477term of ten years of the Maysvilie & Lexington Railroad, fxom Paris to the city of Lexington.
