In 1892 the District Court of the United States for the first judicial district of the Territoiy of Utah was being held in the county court-house of the count}7 of Utah, at Provo City. At that time the county authorities of said county of Utah notified the United States Government to vacate and remove from the court-house and not thereafter to hold court therein. The claim of the petitioner is founded on a lease executed on the 30th of August, 1892, of certain premises in the city of Provo, in the then Territory of Utah, to be used by the defendants for the purpose of holding the United States court' of that Territory. The term of the lease is, that the rent was to commence and run from year to year for the period of five years from the date of occupancy, which was on the 13th day of February, 1893.
