The defendant was charged in count 1 of the information herein with the crime of assault by means of force likely to produce great bodily injury; in count 2 with the offense of forcible rape; while count 3 alleged a violation of section 288a of the Penal Code. Upon the trial thereof the jury found him guilty as charged in each of said counts. From the judgments of conviction and the order denying his motion for a new trial defendant prosecutes this appeal.
