*364 In this wrongful death action, Anthony Toste appeals a defense judgment entered in favor of respondents CalPortland Construction, CalPortland Company (CalPortland), V&J Rock Transport, Inc., and Paul Michaelson. Appellant's father, Dan Toste, died after Michaelson backed up a construction truck and hit Toste during a road paving project. Michaelson, an employee of V&J Rock Transport Inc., was providing truck hauling services for the asphalt supplier, CalPortland.
