The appellant, veteran Richard D. Simmons, through counsel, seeks review of a January 1998 Board of Veterans’ Appeals (Board or BVA) decision that denied as legally insufficient a claim of clear and unmistakable error (CUE) in an April 1977 decision by a Department of Veterans Affairs (VA) regional office (RO) that had denied VA service connection for arthritis and a nervous disorder.
