Joseph C. Hillyard appeals through counsel a February 8, 2008, Board of Veterans’ Appeals (Board) decision that dismissed with prejudice his motion to revise or reverse on the grounds of clear and unmistakable error, a February 1987 Board decision that denied entitlement to VA benefits for an acquired psychiatric disorder. The appeal was referred to a panel because it presents a new question of law: whether a motion to revise a Board decision adjudicating a particular claim bars all future motions to revise regarding that same claim even if the theory advanced to support revision…
