This is an admiralty action brought by William Biggs, an injured longshoreman, pursuant to § 5(b) of the Longshoremen’s and Harbor Workers’ Compensation Act, 33 U.S.C. §§ 901-950 (1976). The defendant, Logicon, Inc., is the owner of an unmanned liquid cargo barge, the Barge Logicon 1300X. Biggs seeks damages for injuries which he alleges resulted from Logicon’s negligence. The case was tried to the court 1 without a jury. At the close of plaintiff’s evidence, Logicon moved for an order of involuntary dismissal pursuant to Fed.R.Civ.P. 41(b).
