Prior to the commencement of this action, a petition was made to the United States District Court for the Western District of New York praying that the R. M. B. C. Corporation be adjudged a bankrupt, and an application was simultaneously made for the appointment of a receiver to take charge of and hold the property of the said corporation prior to the adjudication.
