This was an action commenced in the district court' of Delaware county by Walter E. Taylor, State Bank Commissioner of the state of Arkansas, and F. F. Freeman, Deputy State Bank Commissioner of the state of Arkansas, two of the defendants in error, against the plaintiffs in error, J. J. Kriewitz, Clara O. Krie-witz, and Glenn Kriewitz, to recover upon a promissory note and foreclose a real estate mortgage upon certain property in Delaware county securing the same.
