Richmond Food Stores, Inc. made application to the State Milk Commission (hereinafter called the Commission) for a distributor license on the Richmond milk market. In accordance with the established procedure of the Commission, the application was forwarded to the Richmond Local Milk Board for recommendation. The Local Board recommended by a vote of three to two that the application be denied for the following reasons: (1) Approval would not be in the public interest; (2) the Richmond market is adequately served by five distributors; (3) there is no evidence of necessity for an additional…
