The prisoner was convicted of the murder, in the first degree, of Marguerite Isabelle Stewart, an unmarried woman. In response to a motion for a bill of particulars filed by the prisoner and allowed by the judge, the district attorney specified that the crime was committed between the hours of 12 o'clock noon and 8 p.m., on March 30, 1928, and averred that the Commonwealth was unable to specify the exact spot where the crime was committed, or to specify or describe the instrument used in the commission *384of the crime beyond stating that it was an instrument of sufficient weight and substance to…
