The defendant was indicted for the murder of Dominic R. Cammarata in Canton on June 26, 1967, and following a trial was found guilty of murder in the first degree without a recommendation. The sentence of death was imposed on January 31,1969. The trial judge reported the case under the provisions of G. L. c. 278, § 30, and on May 13, 1974, the single justice allowed full and direct appeal under G. L. c. 278, §§ 33A-33G.
