1Per curiam
This action was instituted in a justice of the peace court of Pottawatomie county by the plaintiff in error, hereafter referred to as plaintiff, against the defendant in error, hereafter referred to as defendant, to recover the sum of $90 alleged to be due as a commission on the sale of real estate.
Trial to a jury in the justice court resulted in a verdict in favor of the plaintiff. The cause was thereupon appealed to the county court, where it was again tried de novo to a jury and a verdict was returned in favor of the defendant. The plaintiff appeals from the judgment rendered on said…
