I. Procedural History
On March 2, 1993, the plaintiffs, Urschel Farms, Inc., and Harding Farms (hereinafter referred to jointly as “Urschel Farms”), filed a complaint in Wabash Circuit Court against Dekalb Swine Breeders, Inc. (“Dekalb”), alleging fraudulent misrepresentations. On March 29, 1993, the defendant filed its notice of removal with this court, which has diversity jurisdiction pursuant to 28 U.S.C. § 1382.
