MEMORANDUM OPINION
SUE L. ROBINSON, District Judge.
I. INTRODUCTION
This is a civil action between the citizens of different states, and the matter in controversy exceeds the sum of $50,000. Therefore, the court has original jurisdiction pursuant to 28 U.S.C. § 1332(a)(1).
Before the court is a motion for summary judgment filed by plaintiff Pig Improvement Company, Inc. (“PIC”) against defendants Middle States Holding Company, Inc. and Delmarva Farms Corporation (collectively “Delmarva”) on Delmarva’s amended counterclaim.
