This case arises from an investigation by appellee Consumer Product Safety Commission (“CPSC” or “the Commission”) of automatic sprinkler heads manufactured by appellant Reliable Automatic Sprinkler Company (“Reliable”). Commission com pliance officials informed Reliable that they intended to make a preliminary determination that the sprinkler heads present a “substantial product hazard” as defined by the Consumer Product Safety Act (“the Act”), 15 U.S.C. § 2064(a).
