Spencer Tracy Holloway, (“petitioner”), presently confined, seeks the issuance of a writ of habeas corpus pursuant to 28 U.S.C. § 2254. In his application petitioner challenges his conviction on one count of first degree murder, M.C.L.A. 750.316; M.S.A 28.548, and one count of possession of a firearm in the commission of a felony.
