This matter is before the Court on the report and recommendation of the magistrate judge (Filing No. 65 in 8:99CV0315; Filing No. 64 in 4:99CV3056; Filing No. 16 in 4:99CV3153; Filing No. 42 in 4:99CV3154), in which he ordered that all four of the above referenced cases be consolidated, plaintiff William Schneider and Rails to Trails Conservancy (“RTC”) be allowed to intervene into the Seger and Gray cases as plaintiff and defendant respectively.
