Goodrich, P. J.:

The plaintiffs, as executors of Marvelle W. Cooper, on June 26, 1896, made a contract with the defendant by which the plaintiffs, as such executors, agreed to sell, and the defendant agreed to buy, twenty-four lots in Brooklyn, for the sum of $2,300 per lot, aggregating $55,200, the deed to be delivered on July twentieth. At the time of the contract the defendant gave a check for $250 on account of the purchase price, and this check was deposited in his bank by the plaintiffs’ agent, but the payment was stopjied, and before the twentieth of July the defendant notified the…
