On error from the supreme court. The cause was originally commenced in the court of common pleas of the county of Columbia, by the present plaintiffs in error, on a bond of indemnity against the maintenance of a bastard. *It was tried in the common pleas, where a verdict and judgment were rendered for the plaintiffs. Thence the cause went to the supreme court on writ of error, upon a bill of exceptions taken at the trial, where the judgment of the common pleas was reversed.

This was an action of debt in the common pleas of Columbia county, on the bond executed by John Donnelly, the reputed father of an illegitimate child, and the defendant and others as his sureties, to the overseers of the poor of the town of Clermont, in the county of Columbia, with condition to save, defend and keep harmless and indemnify, as well the overseers and their successors for the time being, as also all and every other the inhabitants of the town, of, from and against all costs, charges, taxes, rates, assessments, damages or expenses, for or by reason of the birth,…
