THOMAS, Justice.

This appeal is taken from a summary judgment entered in favor of the plaintiffs in an action which was brought to quiet the title to a certain tract of land in Big Horn County. While the Complaint encompassed the title to the entire tract, it was the title to the mineral estate which was in issue. No argument here is made that there was any issue of material fact or that the case was not one in which summary judgment was appropriate.
