Lamborn, the plaintiff in error in this case, is the. trustee and representative of the National Land Company.. This company had contracted with the Kansas Pacific Railway Company for the purchase of- a large quantity of the lands in Kansas, to which the latter company was entitled under the congressional grant made to it, under the name of the Leavenworth, Pawnee, and Western Railroad Company, and the Union Pacific Railroad Company, Eastern Division, by the' acts of July 1, 1862, and July 2, 1864.
