Under date of July 7, 1958, pursuant to the petition of the petitioners Agnes Grant and Roy Grant, Jr., a writ of certiorari was issued out of this court directing the respondent circuit court for Waukesha county to certify and return to this court a full and complete transcript of the rec*614ord, judgment, and proceedings in that certain matter pending in said circuit court in which Henry Wegner is the plaintiff and the petitioners are the defendants.
