MEMORANDUM OPINION AND ORDER
I. INTRODUCTION
ALBRITTON, District Judge.
This cause is now before the court on the motion for partial summary judgment filed by Defendants, National Railroad Passenger Corporation (“Amtrak”), M.L. Cheatwood (“Cheatwood”), and CSX Transportation, Inc. (“CSX”) on January 3, 1994.
Plaintiff, Eddie J. Stanton (“Stanton”), filed this action on December 14, 1992 in the Circuit Court of Lowndes County, Alabama. Defendants removed the case to this court on December 22, 1992. Stanton alleges negligent and/or wanton conduct in both the operation of an Amtrak train and in the…
