This proceeding is before the Court for the disposition of two Motions for Summary Judgment filed by the Plaintiff, West-chester Enterprises, Inc. (hereinafter “Westchester”) and one of the Defendants, Mercor, Inc. fka Diversified Business Ventures, Inc. (hereinafter “Mercor”).
