ORDER
On July 8, 1994, the District Court of Choctaw County found that Petitioner had been denied an appeal through no fault of his own and recommended an appeal out of time. On July 27, 1994, Petitioner filed an Application for an Appeal Out of Time with the Clerk of this Court. The State was ordered to respond on September 5, 1994, and filed a response with the Clerk of this Court on September 26,1994.
