Appeal by the defendants, Isidore Goldman and others, from a judgment of the Supreme Court in favor of the 'plaintiff, entered in the office of the clerk of the county' of New York on the 24th day of May, 1901, upon the verdict of a jury, and also from an order entered in said clerk’s office on the 12th day of June, 1901, denying the defendants’ motion for a new trial made upon, the minutes.

One Sadie Tischler brought an action in the Municipal Court of the city of New York against Abraham Fishman to recover the purchase price of certain - furniture alleged to have, been sold .by her *357and her assignors to him, and in the action a warrant of attachment was issued and a levy made by the marshal upon some of the furniture claimed to belong to Fishman, but which was at the time in possession of the defendant Isidore Goldman.
