The plaintiff’s evidence tended to prove that while he was employed by the defendant he applied for an increase of wages and was told by the defendant’s superintendent that he was at liberty to leave at any time if he could better himself. The parties to this action do not agree as to what facts the evidence tended to prove. The defendant argues-that because he asked Trull to retain the plaintiff as an employee, therefore it cannot be found that the defendant sought to cause the plaintiff’s discharge by Trull. The plaintiff’s claim is that the request to retain him might be found to be a mere cover, well understood by both parties to the conversation. His claim is well founded. A jury might believe that the complaint made by the defendant to Trull was false, and that the defendant, after he had encouraged the plaintiff to seek…
