Plaintiff Brian Biles, MD, MPH (“Dr. Biles”), brings an action against defendant U.S. Department of Health and Human Services (“HHS”) under the Freedom of Information Act (“FOIA”), 5 U.S.C. § 552 (2012), for injunctive relief, claiming that HHS is unlawfully withholding information that Dr. Biles requested in a proper FOIA request.
