This is an appeal from a judgment notwithstanding the verdict in an action for malicious prosecution. About noon on October 4, 1946, Mrs. Sutherland was taken into custody and confined in the psychopathic ward upon an order of detention based upon a petition prepared by Dr. Andrews, the county psychiatrist, and verified by the defendant Palme. The matter was set for hearing on October 10, but she was released about noon on October 6 on the suggestion of Dr. Andrews, with the approval of the judge.
