OPINION

By HORNBECK, J.

This is an appeal on questions of law and fact from a judgment of the Common Pleas Court in favor of plaintiffs and agamst defendant in the sum of $845.00 with costs.

Plaintiffs in their amended petition say that they are children and heirs at law of Gustave A. Hodapp, deceased, and that the defendant is the surviving spouse of decedent; that decedent died January 6, 1935, intestate seized of real estate described, which, it is asserted, was the mansion house of said Gustave A.
