This appeal is from a summary judgment for the defendants in Cause No. 11,996 in the trial court styled H. E. Evans v. Her-minne Venglar, et al. The summary judgment record in the trial court consisted of certified copies of the pleadings and decree from Cause No. 11,735 in the district court of Victoria County, Texas, styled Mrs. Gilbert Venglar, et al. v.
