1Per curiam
As set forth in the joint stipulation between Mark Froelich and the Office of Disciplinary Counsel, the Board of Professional Responsibility of the Supreme Court of the State of Delaware recommended that Froelich be subject to public reprimand and two years of public probation. Froehlich and the ODC did not object to the Board’s recommendation. This Court, by letter dated May 14, 2003, requested supplemental memos from the parties regarding the applicability of In re Bailey. 1 We review this matter in light of the recent ruling in In re Bailey in an effort to apply its teachings consistently.…
