This environmental-law proceeding involves the validity of a permit issued by the defendant, the Secretary of the Army, (Secretary or Army), to the Hampton Roads Energy Company, 1 a company seeking to build an oil refinery on Chesapeake Bay at Portsmouth, Virginia.
