JERRY E. SMITH, Circuit Judge:

Enrique Elizondo was convicted of conspiracy to commit mail fraud. We affirmed his conviction but remanded for resentencing in light of United States v. Booker, 543 U.S. 220, 125 S.Ct. 738, 160 L.Ed.2d 621 (2005). He now appeals his new sentence, including the restitution order. We affirm the restitution but vacate the sentence and remand for resentencing.
